Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Keeping Family Ties ("KFT," "we," "us," or "our") governing your access to and use of the KFT mobile application, website, and related services (collectively, the "Service").

Acceptance of these Terms

By selecting the in-app agreement control, creating or using an account, or otherwise accessing the Service after these Terms are presented, you confirm that you have read, understood, and agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service. We may keep an electronic record of the versions accepted, the date and time of acceptance, the account involved, and related technical information.

Eligibility and family accounts

You must be legally capable of entering this agreement. A person under the age of legal majority may use KFT only with the involvement and consent of a parent or legal guardian and as permitted by applicable law. The parent or guardian is responsible for the minor's use of the Service. You may participate only in families and content for which you are authorized. You may not bypass permissions, access another person's account, misrepresent your identity, or misuse invitations.

User content, privacy, and copyright

You remain responsible for all content you upload, import, publish, or share through KFT. You must own that content or have all permissions, licenses, consents, and other legal rights needed to use and share it. You agree not to publish or share another person's content or personal information in a way that violates privacy, publicity, copyright, intellectual-property, confidentiality, or other restrictions under the laws applicable in the relevant country.

You must not upload unlawful, infringing, malicious, deceptive, abusive, threatening, exploitative, or unauthorized content. You grant KFT a limited, nonexclusive license to host, copy, process, transmit, and display your content only as reasonably necessary to operate, secure, support, and improve the Service and provide features you request. You retain ownership of your content.

Third-party and public information

The Service may help you access or import information from third parties or public sources, such as contacts you select, recipe sources, and amateur-radio or emergency directories. Availability through KFT does not transfer ownership or give you permission to republish content. You are responsible for complying with source terms, licenses, attribution requirements, privacy rights, and applicable law.

Acceptable use

You may not use the Service to violate law or another person's rights; harass, threaten, exploit, or impersonate anyone; distribute malware; interfere with the Service; probe or defeat security controls; scrape or harvest information without authorization; or use KFT content or systems to develop an unauthorized competing dataset or service.

Indemnification and duty to defend

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless KFT and its owners, officers, employees, contractors, service providers, licensors, successors, and assigns (collectively, the "KFT Parties") from and against any third-party claims, demands, actions, proceedings, liabilities, judgments, damages, losses, fines, penalties, settlements, and costs and expenses, including reasonable attorneys' fees and defense costs, arising out of or relating to: (a) content you upload, import, publish, or share; (b) your violation of these Terms, applicable law, or another person's privacy, publicity, copyright, intellectual-property, confidentiality, or other rights; (c) your misuse of the Service; or (d) your fraud, negligence, or willful misconduct.

This means that if your failure to follow these Terms causes or contributes to a covered claim, you are responsible, to the fullest extent permitted by law, for the reasonable costs of defending that claim and for resulting covered liability. KFT may elect to control the defense with counsel of its choice, and you agree to cooperate reasonably. You may not settle a covered claim in a manner that admits fault by, imposes obligations on, or fails to fully release a KFT Party without KFT's prior written consent. This section does not require you to indemnify a KFT Party for that party's own fraud, willful injury, or other responsibility that cannot lawfully be transferred to you.

Subscriptions and purchases

Pricing, renewal, cancellation, trials, grace periods, and refunds are governed by the purchase terms shown at the time of sale and applicable platform rules. Purchases made through Apple are also subject to Apple's applicable terms and billing policies.

Availability, backups, and changes

The Service may change, be interrupted, or contain errors, and uninterrupted availability is not guaranteed. Maintain independent copies of especially important records. We may modify, suspend, or discontinue features and may update these Terms. If changes are material, we will provide notice when appropriate and may require acceptance of a new version before further use.

Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, or security. Nothing in the Service is legal, medical, financial, tax, emergency-response, or other professional advice. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, the KFT Parties will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or loss of goodwill arising from the Service. KFT's aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid KFT during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. These limits do not apply where prohibited by law.

Suspension and termination

You may stop using KFT and request account deletion through the app. We may restrict, suspend, or terminate access when reasonably necessary to protect users or the Service, investigate misuse, comply with law, or address a material or repeated breach. Provisions that by their nature should survive termination—including ownership, indemnification, disclaimers, liability limits, and dispute provisions—will survive.

California law and exclusive Placer County forum

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service are governed by the laws of the State of California, without regard to conflict-of-laws principles. To the fullest extent permitted by applicable law, you and KFT irrevocably agree that the Superior Court of California, County of Placer, shall have exclusive jurisdiction and shall be the exclusive venue for any such dispute, claim, or controversy. If a claim is within the exclusive jurisdiction of the federal courts, it must be brought exclusively in the United States District Court for the Eastern District of California. You and KFT consent to personal jurisdiction in those courts and waive objections based on inconvenient forum or improper venue.

This forum provision does not prevent either party from bringing an eligible individual claim in small claims court in Placer County, California, and does not override a non-waivable right or remedy provided by applicable consumer law.

General terms

These Terms and the documents they incorporate are the entire agreement concerning the Service. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without KFT's written consent; KFT may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
